Please read these Terms of Service ("Terms") carefully before using NirvanaIoT ("the Service"), operated by Nirvana Technologies. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using NirvanaIoT in any way, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to create an account or use the Service. By registering, you confirm that you meet this requirement. We reserve the right to terminate accounts found to be held by minors.

3. Description of Service

NirvanaIoT is a web-based IoT platform that allows registered users to remotely monitor and control ESP32-based devices over the internet. The Service includes a web console, MQTT-based device connectivity, a drag-and-drop control builder, logic rules automation, and firmware provisioning tools.

4. Plans & Pricing

NirvanaIoT offers the following plans:

Free Plan — available for 7 days from the date your account is created, at no charge. After 7 days, continued access requires a Premium plan.
Premium Monthly — ₹299 per month, billed as a one-time, non-recurring payment.
Premium Yearly — ₹499 per year, billed as a one-time, non-recurring payment.

Payments from India are processed via Cashfree. International users may pay using cryptocurrency. Prices are subject to change with prior notice posted on this page.

5. Account Registration

You must provide a valid email address to create an account. You are responsible for the security of your email account, as it is the sole means of authentication. You agree to:

Provide accurate information when registering.
Notify us immediately if you suspect unauthorised access to your account.
Not share your session token or account access with others.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

Use the Service to control devices in ways that could cause harm to people, property, or the environment.
Attempt to reverse-engineer, compromise, or disrupt the platform's infrastructure.
Register devices you do not own or do not have explicit permission to operate.
Use the Service in violation of any applicable laws or regulations.
Abuse the platform in ways that degrade service for other users (e.g., excessive API requests).

7. Device Safety & Electrical Disclaimer

NirvanaIoT involves the remote control of physical hardware, including devices connected to electrical circuits. You are solely responsible for the safe installation, wiring, and operation of any devices connected through this platform.

Always follow proper electrical safety practices. Work involving mains voltage must be performed by a qualified electrician where required by law.
Ensure all connected devices comply with applicable local electrical codes and safety standards.
Do not use the Service to control devices in unattended, safety-critical, or life-safety applications without appropriate independent safeguards.
Never work on live electrical circuits. Always isolate power before making any physical connections.

Nirvana Technologies and its creators are not responsible for any damage, injury, fire, electrical fault, data loss, or any other loss — direct or indirect — arising from the use, misuse, or malfunction of devices connected through NirvanaIoT. Use this platform at your own risk.

8. Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uptime. The Service may be interrupted for maintenance, updates, or circumstances beyond our control. We are not liable for any losses arising from service interruptions.

9. Intellectual Property

The NirvanaIoT platform — including its code, design, and branding — is the property of Nirvana Technologies. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You may not copy, modify, or distribute any part of the platform without prior written permission.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your device and account data will be removed. No refund is issued for any unused portion of a paid plan upon voluntary termination.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Nirvana Technologies and its creators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to property damage, electrical damage, data loss, or personal injury.

13. Changes to Terms

We may revise these Terms at any time. Updated Terms will be posted on this page with a new effective date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Buldhana District, Maharashtra, India.
